Family of the mother of BC, killed by a runaway van, sues Amazon, driver

The family of a woman killed by an escaped delivery van in December 2020 is now suing Amazon, two companies and the delivery driver for damages.

Paramjit Masuta was walking his eight-year-old twins from school on December 15, when the collision took place near 144 Street on 61A Avenue.

The lawsuit alleges that the 47-year-old Masuta pushed her daughters off the road, but failed to avoid being hit and dragged under the vehicle.

She suffered “serious injuries”, the case said, and died on the spot.

The van was driven by Joe Kurian, who was out of the vehicle at the time, delivering to Amazon and, or, Damy Logistics.

The Ford somehow rolled down 144 Street, hit a southern vehicle, crossed north and then rolled onto the sidewalk, the lawsuit said.

It also states that the van was parked illegally because it is facing north against traffic.

The lawsuit says Kurian did not park the van safely, including not using the emergency brake or parking the vehicle and driving it at a time when “his ability to do so was impaired by drug use. , alcohol, fatigue, medical reasons or other reasons. “

It also states that Amazon, Damy Logistics or Foss National Leasing have been negligent in failing to provide Ford’s van with appropriate braking systems, warning devices and any other devices necessary for the proper and safe operation of the vehicle.

In addition, the case alleges that the companies were negligent because they did not know or did not have the means to know that Kurian was incompetent to drive.

The Masuta family, Paramjit’s husband and two children are seeking compensation for the loss of leadership and friendship of his wife and mother, future loss of support, loss of household allowance, loss of past and future income and loss of inheritance.

None of the allegations have been proven in court, and neither Kurian, Amazon, Damy Logistics, nor Foss National Leasing have filed a statement of defense in response.
