Hillary Clinton asked a federal court on Wednesday to dismiss a lawsuit from former President Donald Trump accusing her and the Democratic National Committee of plotting against him to tarnish his 2016 campaign.
Clinton’s lawyers say Trump’s $ 24 million case, which is alleged to be an “unthinkable conspiracy” to “mutilate” his presidential candidacy and outline his campaign as a conspiracy with Russia, has no legal basis, according to a request. , filed in the U.S. District Court for the Southern District. Florida.
“Whatever the benefit of the plaintiff’s complaint as a fundraising tool, press release or list of political complaints, it is unfounded as a lawsuit and must be rejected with prejudice,” the 22-page court file said.
In a 108-page complaint filed last month, Trump said Clinton and others had staged a plan to craft a scandal with Russia to thwart his candidacy in 2016, when he ran as a Republican candidate against Clinton.

Clinton’s lawyers said that Trump had not adequately proven that their client was involved in some alleged conspiracy – and even if it was, the statute of limitations would have passed to some of the events.
They cited a series of tweets from Trump in October 2017, when he blamed Clinton for Steele’s scandalous file and complained about the lack of investigation, writing “DO SOMETHING.”
“But despite his provocative call for action in capital letters, the plaintiff waited four years, four months and twenty-four days before filing a lawsuit,” Clinton’s lawyers wrote. “Delaying him makes his every request untimely.”
Trump’s allegations within the organizations influenced by racketeering and corrupt organizations, or RICO, have a four-year status, as well as allegations of conspiracy to commit a malicious lie and conspiracy to commit malicious prosecution, Clinton’s lawyers said.

Other aspects of Trump’s long appeal were protected by “public speech with which he disagrees,” lawyers said. Trump has accused Clinton’s campaign of stealing trade secrets, but Clinton’s lawyers say information gathered by the DNS from Trump Organization computers is classified as a “trade secret.”
Clinton’s lawyers also said that Trump had not proved correctly that Clinton was involved in any of the alleged conspiracies, describing his complaint as “a merger of political complaints against twenty-eight named defendants and several unnamed entities.”
“The plaintiff claims most of all that other entities sought to continue Clinton’s candidacy and after the election were politically opposed to the plaintiff’s administration,” the proposal said. “This behavior is clearly protected by the First Amendment and there is nothing illegal in engaging in political activity.

If a judge removes Clinton from the case, it may not affect other defendants, including former DNC chairwoman Debbie Wasserman Schultz and Christopher Steele. The other named defendants have not yet formally filed a lawsuit.
Russia’s interference in the 2016 election has long been a point of contention between Trump and Democrats and was the subject of his failed first impeachment. A 2020 report by the Republican Senate Intelligence Committee found that Russia was “committed to aggressive, multilateral efforts to influence or try to influence the outcome of the 2016 presidential election.”
