A federal judge in San Francisco has rejected a lawsuit filed by former President Trump against Twitter, arguing that the social media company has banned itself and others from the platform.
U.S. District Court Judge James Donato granted Twitter’s request to dismiss the case on Friday.

Danto allowed Trump’s lawyers to file an amended complaint “in accordance with this order” by May 27, adding that it could not contain new claims or defendants without prior court permission.
The lawsuit alleges that Twitter violated the First Amendment to the United States Constitution, argues that Section 230 of the Communications Decency Act is unconstitutional, and also claims that Twitter used “fraudulent and misleading practices” in violation of the fraudulent and unfair trade of Florida Law Practices.
Donato wrote in his order that the First Amendment does not apply to private companies, adding that Trump “does not start from a position of strength.”

Twitter banned Trump in January 2021 and claims he contributed to the violence that took place in the Capitol on January 6.

The lawsuit was originally filed in the United States District Court for the South District of Florida before being transferred.
