The parents of a man who died on suspicion of a severe allergic reaction after ordering pizza are calling for better allergen displays to be placed on home boxes.
James Atkinson died on July 10, 2020, after ordering pizza for home from the Dadyal restaurant in Newcastle, according to his family’s Lee Day lawyers. The 23-year-old Leeds man had a known allergy to peanuts and his family was told he may have had a severe allergic reaction.
His death is due to be investigated on Tuesday before an investigation in the Newcastle court. Gulfam Ulhak, who is believed to have owned a restaurant, told the BBC in 2020 that Mr Atkinson’s order was made through Deliveroo and that the website contained “very clear” information on allergens and food hygiene. .

At the time, Dadyal’s “restaurant notes” section had a “cross-contamination notice” for peanuts, according to Deliveroo sources. Mr Atkinson’s parents said their son was “conscientious” in checking the ingredients. They want clearer manifestations of allergens to prevent such an incident from happening to another family.
His father, Stewart, told the Sunday Times: “We would like to see a simple system with a check box before you place an order – do you have allergies, yes or no? If you check “yes”, she instructs you to contact the restaurant by phone. Allergy information is always hidden. It has to be up front. “
His mother, Jill, added: “What everyone needs is a clear, complete list of ingredients for each item on the home food menu and a sticker on the home box that says the allergens it contains. We’ll never know if that would save James, but it could have happened … we just don’t want it to happen to another family. “
Mr. Atkinson graduated in computer science from the University of Newcastle and stayed in the city where he lives with friends. The Atkinson family, which raises funds for their case through CrowdJustice, is represented by Thomas Jervis, a Leigh Day partner, and has instructed lawyers Craig Hasal QC and Helena Spector of Park Square Barristers Chambers.
Dadyal, located on Howard Street in Newcastle, was immediately stopped by Deliveroo following Mr Atkinson’s death in July 2020. However, he remained on other platforms until police and environmental health officials confirmed that may trade again later that month.

Neither Deliveroo nor the carrier are suspected in the case, sources said. Deliveroo encourages customers to contact restaurants directly about the ingredients and cooking methods shown in the “restaurant information” section and the “allergens, hygiene assessment and others” section, both at the top of its menus.
Restaurants can also add allergen notes to appear under each product. Staff are encouraged to be trained to respond to phone allergy inquiries in restaurants where menus and ingredients change regularly.
The Food Standards Agency (FSA) says food businesses should inform customers if the products they offer contain ingredients from a list of 14 allergens. It is added that home establishments must provide information on allergens before food is purchased and when it is delivered.
A Deliveroo spokesman said: “This is a tragedy and our thoughts are with the family and friends of the young man, who unfortunately died. Deliveroo contacted the police, who confirmed that the company had acted properly at all times and continued to comply fully with this investigation.
“The company will cooperate fully in the forensic doctor’s investigation and will share all the information requested by the medical examiner. We are committed to doing our best to support this investigation and our hearts are on everyone involved.”
