WASHINGTON – The Supreme Court on Wednesday ruled 5-4 that Oklahoma can persecute non-Indians in the Indian country, revoking part of its 2020 decision recognizing nearly half of the state’s reservation.
The case renewed the sharp division in court over US attitudes toward Native American tribes and its legal implications today. Judge Brett Cavanaugh’s majority holds a limited view of the sovereignty that tribes retain in America in the 21st century, while Judge Neil Gorsuch’s disagreement over centuries of broken promises to the Indians says the court must impose long-ignored treaties today. .
