9th Circuit to take up Hawaii firearms case again after Supreme Court ruling

HONOLULU (HawaiiNewsNow) – After the U.S. Supreme Court ruled last week to expand gun rights, he says a gun case in Hawaii deserves another look.

On Thursday, the Supreme Court sent Big Island resident George Young Jr.’s case back to the Ninth Circuit Court of Appeals for a new ruling.

Young Jr. and his attorney, Alan Beck, hope to remove the statute’s “exceptional case” rule that makes it harder for people to get a permit to carry a firearm in Hawaii.

Beck said he believes the Supreme Court’s decision last week could lead to a successful lawsuit.

“This lawsuit will eliminate the increased need requirements, so it will make it dramatically easier to obtain a permit to carry a handgun in the state of Hawaii,” Beck said.

“The decision has already been made because last week the Supreme Court ruled on the New York case, the Bruen case. You know, they specifically wrote a long opinion saying that these types of “emergency” requirements are unconstitutional.”

Beck said the Ninth Circuit Court of Appeals should make a new decision in the near future.

If the “exceptional case” rule is lifted, state lawmakers say they are already working on legislation that would strengthen Hawaii’s gun laws.
