OSH charges brought against Triple J Aggregates Limited in fatal workplace accident

The provincial government has announced that occupational health and safety charges have been laid against a company and a supervisor in connection with a fatal workplace accident in September 2020.

Triple J Aggregates Limited of Conception Bay South faces 11 charges and the manager faces one charge in connection with the incident, which occurred at a quarry near St. John’s.

Most of the charges against the company are related to the use of equipment. It is alleged that they failed to ensure that workplace equipment was capable of performing its functions, that adequate safeguards were in place and that machinery was used in accordance with the manufacturer’s instructions.

They are also accused of failing to maintain the health, safety and welfare of workers, providing adequate training and supervision, failing to ensure that work procedures promote safe worker interaction and failing to ensure that all workplaces and equipment are capable of withstanding of the strain likely to be placed upon them.

The supervisor faces one charge for allegedly failing to ensure the health, safety and welfare of workers under their supervision.

Initial court appearances are scheduled for Aug. 19 in St. John’s Provincial Court.
