TORONTO –
Warning: This story contains disturbing allegations.
Defense attorneys have suggested that a young woman fabricated a “rape story” by Canadian musician Jacob Hogard because she was ashamed to fall in love with a rock star who used her for sex.
During a cross-examination on Monday, attorney Megan Saward suggested that Hogard and the woman, who was 16 at the time, had sex by mutual consent in the singer’s hotel room in Mississauga, Ont., In September 2016, after as he sent a limousine to pick her up in her hometown north of Toronto.
Saward suggested that the teenager was upset at the end of the meeting because Hoghard had called the driver to pick her up and she was too embarrassed to tell her friend – one of the two people who knew where she had gone – why she was leaving for hours. earlier than planned.
“What upset you was the fact that after having sex with this rock star, he called the car to pick you up earlier,” Savard told the woman during the trial against Hogard for sexual abuse in Toronto. .
“The thing that upset me was that he had sex without my consent, where he hit me, I was bleeding and I kept telling him I wasn’t crying. That upset me, “the woman replied.
“I was very happy to leave this room, I couldn’t wait to get out of this room,” she said, adding that she was the one who wanted to be picked up early after pretending to be called to work.
The woman said she was not ashamed to tell her friend what had happened, but felt “emotional” in light of what she had just experienced.
At various points in her cross-examination, Savard suggested that the teenager told the same “story” to her mother more than a week later to win her sympathy and take her to the hospital to be tested for pregnancy and sexually transmitted infections. .
She also suggested that the teenager felt “like a fool” because he believed Hogard’s remarks and had sex by mutual consent, which was “meaningless to him.”
“You were upset that you fell in love with a rock star and that he used you for sex,” she said.
The woman admitted she was upset, but said she felt “betrayed” because she had been raped. She realized she had been manipulated into trusting Hogard, she said. Earlier, she told the court that she was a big fan of Hadley, the group led by Hogard, and was “in love with fans” for the singer from an early age.
The woman, who is one of the two complainants in the trial against Hogard for sexual assault, claims that the singer repeatedly raped her vaginally and orally in his hotel room and tried to do it anal. She told the court that he called her a “slut” and a “whore” and that she deserved what was happening.
A concerted statement of facts states that Hogard had sexual intercourse with her at a hotel on 30 September 2016. The document states that he also had sexual intercourse with another woman, the second applicant in the case, on 22 November of that year. .
Hogard pleaded not guilty to two counts of sexual assault causing bodily harm and one charge of sexual intercourse, relating to sexual intercourse with a person under 16 years of age.
During his cross-examination on Monday, Savard wondered how Hoghard had been able to detain the applicant during the meeting at the hotel, including while undressing her and his clothes, according to the woman.
The defense attorney also suggested that the woman did not shout or make much noise during the meeting, as she testified, nor did she look disheveled or in pain when she left the hotel room afterwards. Savard noted that Hogard escorted the teenager to the lobby and did not try to hide his presence in public.
Savard suggested that no one at the hotel interfere because the applicant looked as if she had just had “normal” sex by mutual consent.
Earlier Monday, Savard suggested that the woman had “responded” to Hogard’s sexual interest as they exchanged messages at the start of the hotel meeting. She pointed to the fact that the two exchanged nude photos.
The woman replied that although she may have been “potentially” sexually interested in Hogard, they were not “sexting” or describing sexual acts they wanted to do.
“There has never been a message saying I want to have sex with him,” or a discussion about sex the day they met, she said.
The defense later noted that as she was preparing to meet with Hogard on September 30, the teenager asked her friend to help her choose clothes, including underwear.
“I’m going to suggest that you make sure your underwear matches your bra because you planned to see it, Mr. Hogard, that day,” Savard said.
The applicant rejected this offer, stating that she regularly wore appropriate underwear.
Savard also suggested that the woman thought Hogard had repeatedly touched her buttocks after a concert in Toronto in April 2016, just weeks after they began sending messages.
The woman began her testimony last Thursday, saying she had met Hogard several times at Hadley’s concerts and fan events, and they began sending each other messages after a meeting and greeting when she was 15.
She testifies that the messages become romantic and sexual over time, and Hogard tells her that he loves her and sees a future with her.
The other complainant is expected to take up the position on Tuesday.
