Hunter Biden asked a judge to prevent the daughter he had with a stripper from taking the family name.
The son of the US president went to court to oppose the decision of 31-year-old Lundon Roberts to name their four-year-old daughter Navi Biden.
Ms. Roberts, who is raising the girl in Arkansas, filed a petition to change the name last month.
She said Navy would benefit because the name Biden “is now synonymous with being well-educated, successful, financially astute and politically powerful.”
She argued in court filings that Mr. Biden’s “misbehavior or neglect” could be remedied by allowing her to take the surname.
But Mr Biden argued this would deprive the child of a “peaceful existence”.
He suggested that the Navy should be free to decide on its own last name at a time when “disdain for the Biden name is not at its height.”
The latest chapter in the litigation
The legal battle for the family is the latest chapter in the litigation surrounding the president’s scandal-prone 52-year-old son and the love child he has never met.
In September of last year, Mr. Biden asked a court to reduce child support payments, saying he could no longer afford them.
Navy, the fourth of Mr Biden’s five children, was born in late 2017. His paternity was confirmed by a DNA test in 2019.
However, the Navy is not recognized by the family and as a result does not have the same 24/7 Secret Service protection as other presidential grandchildren.
According to Mr. Biden’s own memoir, Beautiful Things, he had no recollection of the meeting.
At the time of the meeting, he was still romantically involved with his late brother Beau’s widow, Hallie Biden.
The latest chapter in the litigation comes as the Republican-controlled House of Representatives plans to target Mr. Biden with congressional investigations into his business dealings and the contents of his personal laptop.
Mr Biden, who had three children with his ex-wife, is now married to South African Melissa Cohen. They have a two-year-old son named Bo.
