Prosecutors in Napa County, Calif., dismissed a “standard” drug charge in a DUI complaint against Paul Pelosi on Wednesday after he was indicted on two felony counts in a crash that wrecked two vehicles and injured the other driver.
The criminal complaint, received Tuesday, alleges that Pelosi injured the other driver “while under the influence of an alcoholic beverage and a drug and under their combined influence.”
But prosecutors confirmed they say he was driving under the influence of alcohol on May 28 — not that he had a drug in his system, as the document states.
Pelosi’s attorney Amanda Bevins told Fox News Digital late Tuesday, “I believe the reference to the drug is part of the statutory template language in the complaint.”

The Napa County District Attorney’s Office agreed with that characterization Wednesday.
“She’s right,” Assistant District Attorney Paul Gero told Fox News Digital. “This is boilerplate language automatically generated in the complaint. Our theory is alcohol.”

Officers allegedly encountered Pelosi sitting in her damaged Porsche 2021, slurring her speech and with a “strong odor of an alcoholic beverage emanating from her breath” after a crash near the intersection of California Route 29 and Oakville Cross Road.

Investigators later determined he had a blood alcohol content of 0.082%.
Both Pelosi and the other driver, identified only as John Doe, refused medical treatment at the scene, but Doe told Napa County prosecutors on June 2 that he began experiencing pain in his upper right arm, right shoulder and door the day after the accident. He also complained of headaches and said it was difficult to pick things up with his right hand, according to the documents.
